These Terms and Conditions of Use (“Terms”) govern your access to and use of the website located at www.farizz.com and any related digital storefronts (collectively, the “Site”) operated by FaRizz LLC, a California limited liability company with its principal place of business in San Diego, California (“FaRizz,” “we,” “us,” or “our”), and the purchase of FaRizz products. Please read these Terms carefully. By accessing the Site, creating an account, or completing a purchase, you acknowledge that you have read, understood, and agreed to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Site or purchase our products.
1. Eligibility
To purchase from the Site you must be at least 18 years of age (or the age of majority in your jurisdiction) and capable of entering into a legally binding contract. By using the Site you represent and warrant that you meet these requirements. If you are using the Site on behalf of an entity, you represent and warrant that you have the authority to bind that entity to these Terms.
2. Account Registration
Certain features of the Site (such as order history, wish lists, and our subscription program) require you to create an account. You agree to provide accurate, current, and complete information; to keep your password confidential; and to be solely responsible for activity that occurs under your credentials. Notify us immediately at [email protected] if you suspect unauthorized use of your account.
3. Products, Pricing, and Availability
All products are made in small batches in San Diego, California. We reserve the right at any time and without prior notice to modify, discontinue, or limit the availability of any product, to correct typographical or pricing errors, and to refuse or cancel any order. If we cancel an order after your payment method has been charged, we will issue a full refund.
Color, scent, viscosity, and appearance may vary slightly from batch to batch because FaRizz Hair Oil is made from natural plant-based ingredients. Such variation is not a defect.
4. Cosmetic Use Only — Important Disclaimer
FaRizz products are cosmetics intended only to cleanse, beautify, promote attractiveness, or alter the appearance of the hair and scalp. They are not drugs and are not intended to diagnose, treat, cure, mitigate, or prevent any disease, including hair loss, alopecia, dandruff, dermatitis, or any other medical condition. Statements made about FaRizz products on the Site or in marketing materials have not been evaluated by the United States Food and Drug Administration.
Always read the full ingredient list and the warnings printed on the product label before use. Discontinue use and consult a licensed healthcare provider if you experience irritation, an allergic reaction, or any other adverse effect.
5. Allergen and Safety Notice
FaRizz Hair Oil contains tree nut–derived ingredients (including sweet almond oil and argan oil) and various essential oils and botanicals. Do not use if you have a known or suspected allergy to any listed ingredient. Perform a 24-hour patch test on the inner forearm before first use. Avoid contact with eyes; if contact occurs, rinse thoroughly with cool water. Keep out of reach of children. Not recommended during pregnancy or for children under six (6) years of age without consulting a licensed healthcare provider.
If you experience a serious adverse event — such as hospitalization, persistent or significant disability, or other reaction requiring medical intervention — please notify us as soon as reasonably possible, and in any event within 30 days, at [email protected]. Upon receiving such a report we are required by the Modernization of Cosmetics Regulation Act of 2022 (MoCRA) to submit a report to the U.S. Food and Drug Administration within 15 business days, and we may contact you for additional information needed to complete that report.
6. Orders, Payment, and Sales Tax
All orders placed through the Site are offers by you to purchase the listed products at the listed price, subject to acceptance by us. Acceptance occurs when we send a shipping confirmation email. Payment is processed by third-party payment processors (currently Stripe and PayPal) and is subject to their terms. We do not store your full payment card details on our servers.
Prices are listed in United States Dollars. Applicable California sales tax is calculated and collected at checkout for shipments to California addresses. International customers are responsible for any customs duties, taxes, or fees imposed by the destination country.
7. Shipping and Risk of Loss
We ship via USPS, UPS, or FedEx within the United States. Estimated delivery times are not guaranteed. Title and risk of loss for ordered products pass to you upon delivery to the carrier. Lost, delayed, or damaged shipments are subject to the policies of the applicable carrier; we will work in good faith to assist you with any claim.
8. Returns and Refunds
Our Return and Refund Policy is incorporated into these Terms by reference and is available at www.farizz.com/returns. In summary, we offer a 30-day satisfaction guarantee on first-time purchases of FaRizz Hair Oil. Please consult the full policy for eligibility, exclusions, and process.
9. Subscription Program (if applicable)
If you enroll in a subscription, you authorize us to charge your saved payment method on a recurring basis at the cadence and price displayed at checkout, until you cancel. You may cancel any subscription at any time through your account dashboard or by emailing [email protected] at least three (3) business days before the next scheduled charge. Cancellations take effect at the end of the current billing period; previously billed amounts are not refundable except as required by law.
10. Intellectual Property
All content on the Site — including the FaRizz name, the FaRizz logo, product names, photographs, illustrations, design elements, written copy, audio, video, and software — is owned by or licensed to FaRizz LLC and is protected by United States and international copyright, trademark, and other intellectual property laws. You are granted a limited, revocable, non-exclusive, non-transferable license to view and use the Site for personal, non-commercial purposes. You may not copy, reproduce, distribute, modify, create derivative works from, publicly display, sell, or otherwise commercially exploit any portion of the Site or its content without our prior written consent.
“FaRizz” and the FaRizz logo are trademarks of FaRizz LLC. All other trademarks referenced on the Site are the property of their respective owners.
11. User-Generated Content and Reviews
If you post a review, photograph, comment, or other content on the Site or tag FaRizz on social media, you grant FaRizz a worldwide, perpetual, royalty-free, sublicensable, transferable license to use, reproduce, modify, adapt, publish, translate, distribute, and display the content in any media now known or later developed for any business purpose, including marketing. You represent that you own or control all rights to the content you submit and that the content does not infringe any third-party right or violate any law.
We reserve the right to remove any user-generated content that is unlawful, defamatory, obscene, harassing, or otherwise objectionable in our sole discretion.
12. Prohibited Conduct
You agree not to: (a) use the Site in violation of any applicable law or regulation; (b) attempt to gain unauthorized access to any portion of the Site or any related systems or networks; (c) interfere with or disrupt the Site, servers, or networks; (d) use automated tools to scrape, crawl, or extract data from the Site without our prior written consent; (e) reverse engineer, decompile, or disassemble any portion of the Site; (f) use the Site to transmit any viruses, malware, or other harmful code; or (g) impersonate any person or entity or misrepresent your affiliation with any person or entity.
13. Third-Party Links
The Site may contain links to third-party websites, services, or resources that are not owned or controlled by FaRizz. We are not responsible for the content, privacy policies, or practices of any third-party site. Your use of any third-party site is at your own risk.
14. Disclaimer of Warranties
THE SITE AND ALL PRODUCTS, CONTENT, AND SERVICES PROVIDED THROUGH THE SITE ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FARIZZ DISCLAIMS ALL WARRANTIES, INCLUDING WITHOUT LIMITATION THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY DEFECTS WILL BE CORRECTED.
15. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL FARIZZ LLC, ITS MEMBERS, MANAGERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES (INCLUDING WITHOUT LIMITATION LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION) ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE OR ANY PRODUCT PURCHASED THROUGH THE SITE, REGARDLESS OF THE THEORY OF LIABILITY AND EVEN IF FARIZZ HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SITE WILL NOT EXCEED THE GREATER OF (a) THE TOTAL AMOUNT PAID BY YOU TO FARIZZ IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (b) ONE HUNDRED U.S. DOLLARS (US$100).
Some jurisdictions do not allow the exclusion or limitation of certain damages; the above limitations apply only to the extent permitted by law.
16. Indemnification
You agree to indemnify, defend, and hold harmless FaRizz LLC and its members, managers, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, judgments, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to: (a) your use of the Site or any FaRizz product; (b) your breach of these Terms; (c) your violation of any law or third-party right; or (d) any user-generated content you submit.
17. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict-of-laws principles. The federal and state courts located in San Diego County, California will have exclusive jurisdiction over any dispute not subject to arbitration under Section 18 below, and you consent to personal jurisdiction in those courts.
18. Dispute Resolution — Binding Arbitration and Class Action Waiver
Please read this section carefully — it affects your legal rights.
Most disputes can be resolved informally. Before filing any claim, you agree to first contact us at [email protected] and provide a brief written description of the dispute and your contact information. We will attempt in good faith to resolve the dispute within 30 days.
If we cannot resolve the dispute informally, you and FaRizz agree that any claim, dispute, or controversy arising out of or relating to these Terms or your use of the Site or our products will be resolved by binding individual arbitration administered by JAMS under its Streamlined Arbitration Rules. The arbitration will take place in San Diego, California, and judgment on the award rendered by the arbitrator may be entered in any court of competent jurisdiction. The arbitrator, and not any federal, state, or local court, will have exclusive authority to resolve any dispute relating to the interpretation, applicability, enforceability, or formation of this arbitration provision.
YOU AND FARIZZ AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION. The arbitrator may not consolidate more than one person’s claims and may not preside over any form of representative or class proceeding.
Notwithstanding the above, either party may bring an individual action in small-claims court for any dispute within that court’s jurisdictional limit, and either party may seek injunctive or equitable relief in any court of competent jurisdiction to protect intellectual property rights.
You may opt out of this arbitration agreement by sending a written notice to FaRizz LLC, ATTN: Legal, [San Diego mailing address], within 30 days of first accepting these Terms. Your opt-out notice must include your full name, mailing address, and a clear statement that you wish to opt out.
19. Changes to These Terms
We may modify these Terms at any time. The most current version will be posted on the Site with an updated “Last Updated” date. Material changes will be communicated by email (to the address on your account if any) or by a prominent notice on the Site at least 14 days before they take effect. Your continued use of the Site after changes take effect constitutes acceptance of the revised Terms.
20. Termination
We may suspend or terminate your access to the Site at any time, with or without cause or notice, including if we believe you have violated these Terms. Sections 4, 5, 8, 10, 11, 14, 15, 16, 17, 18, and 21 will survive any termination.
21. General
These Terms, together with the Privacy Policy and the Return and Refund Policy, constitute the entire agreement between you and FaRizz regarding the Site and supersede any prior agreements. If any provision of these Terms is held unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision will not be deemed a waiver. You may not assign or transfer these Terms without our prior written consent; we may assign these Terms freely. Section headings are for convenience only.
